Is one of the most difficult and least
understood areas of child custody mediation. Legal custody has nothing to do with where the child lives. What legal custody mean is who is
going to make the major decisions pertaining to the child(ren)'s education,
extracurricular activities, medical treatment, religious training, discipline and other
matters relating to the upbringing and well-being of the child(ren). In the state of New Mexico the New Mexico State legislature has decided that joint legal custody is best for children or at least is seen to be in the child's best interest. It
is the understanding of Family Mediation Project that the State Legislature of
New Mexico has made it clear that it presumes it to be in the best interest of
children that both parents share the major decisions in a child’s life.
Joint
legal custody does not necessarily mean that the parents share financial
responsibility for the children or time with the children equally. In
some cases however, SOLE LEGAL CUSTODY IS POSSIBLE and appropriate. If
