NEW REVOLUTIONARY

Interdisciplinary Divorce/ Relationship/Child 

Custody Team  

Collaborative Divorce S M is a new revolutionary approach to the divorce and child custody process, incorporating the legal, emotional and financial elements in a cooperative way that ultimately benefits everyone involved.  

Collaborative Divorce team members may include the following:  

Case Manager    

The Case Manager will conduct the initial interviews with the participants and determine if traditional mediation or collaborative mediation will be utilized.   The Case Manager is responsible for insuring a speedy and timely process.   The Case Manager may also be one of the Mediators/Coaches.  

Mediator/Coach  (gender based is recommended)

The Mediator/Coach will meet with the client one-on-one to prepare for meetings with the other party.  Much of the work may be done over the phone. The Mediator/Coach will be with the client in all face-to-face meetings between the clients. The Mediators/Coaches may meet together to prevent delays or blockages.  

Collaborative Attorney 

If needed, each client shall be able to hire a Collaborative Attorney who will not litigate and will work with the Mediator/Coach and the team.

 Child Specialist

If and when needed, a Child Specialist may be hired to work with the child and/or the parents to ins u re that the needs of the child are addressed and attended to, and who will be an advisor for both parents.  

Financial Specialist

If and when needed, a Financial Specialist may be hired who will be an advisor for both parents.

ALL PROFESS IONAL S INVOLVED SIGN A WAIVER TO NEVER PARTICIPATE IN ANY LITIGATION WITH THIS CASE FOREVER.  

Ø  The team will meet together to problem solve   when delays occur.  

Ø  The team will work together to help the clients agree on issues and gain an undisputed divorce.  

Ø  No team member of the collaborative divorce team will participate in litigation.   

Ø  All collaborative team members shall withdraw from the case if either client chooses to litigate the process.  

Ø  The team is committed to keeping the time involved as short as possible and as inexpensive as possible.

 COLLABORATIVE MEDIATION WORKS WONDERFULLY WELL WITH ATTORNEYS AND MEDIATORS WORKING TOGETHER INSTEAD OF AGAINST EACH OTHER.  

In the Collaborative process, the Collaborative Attorney will not litigate and will work with the Mediator/Coach and discuss the case with the team, however,  

  • The team will recognize the client’s right to litigate

  • ·The team will recognize it is a constitutional right to litigate

  • The team has recognized that traditional litigation and even traditional mediation has a tendency to create problems when children are involved

  • ·The team will recognize that the Collaborative process is an alternative to litigation

  • ·The team agrees that, if the parties choose to litigate, the right to litigation shall not be interfered with

The Collaborative process ultimately benefits everyone involved in the following ways:  

  • Support between professionals to resolve emotional issues

  • Cooperative discussions  between professionals to avoid delays

  • A continued support toward peaceful resolution

  • A broad based education regarding children’s issues

  • Fairness, full disclosure, no secrets

  • The professionals view the entire family as the client reducing alliances and coalitions which interfere with peaceful resolution

  • Alternative dispute resolution is more beneficial to children

  • If any two of the professionals decide this case is unable to be collaboratively mediated, the professionals will close this collaborative process

  • Less time invested by the parents and the professionals involved

  • Less money invested by the parents
